Puppy Agreement
Sound Retrievers (Seller) and buyer (Owner) enter into this agreement (Agreement) regarding Labrador puppy (Pet) purchased from Sound Retrievers, effective upon Seller’s receipt of payment in full for Pet.
Seller and Owner agree:1. Agreement is between Seller and Owner, does not benefit any third party, and is not transferrable.2. Owner statements in Sound Retriever Puppy Application (SRPA) are true and accurate.3. Information, including terms and conditions, at SoundRetriever.com at time of SRPA submittal, such as on Frequently Asked Questions page, is/are acceptable and applicable.4. Seller will provide results of genetic testing panels for Pet's parents; identification of one or more markers does not mean subject disease(s) is/are present or will manifest in Pet.5. Pet is in visually good health at the time Owner takes possession of Pet.6. Except as expressly provided herein, Seller has no liability for any injury or sickness once Pet leaves the care of Seller.7. Pet is sold with AKC Limited Registration. Unless Owner obtains AKC Full Registration from Seller, any offspring of the pet are not AKC registered Labrador retrievers. Any breeding of Pet will be conducted responsibly, including appropriate health certifications of Pet and mate(s).8. Spaying or neutering is responsibility of Owner. Spaying or neutering is not required. Spaying or neutering prior to 12 months of age will void Seller guarantee of hips.
Seller’s guarantee:Seller guarantees Pet to be free from hip dysplasia, diagnosed by radiographic screening prior to 26 months of age,Provided:1. Pet has not been spayed or neutered prior to 12 months of age,2. Pet has not been bred or sired a litter,3. Pet’s dewclaws were intact at time of x-ray, and4. Pet has been within 10 pounds of normal or healthy weight at approximate ages of 12, 18, and 24 months, as represented by veterinarian records and written statement.Pet is deemed to have hip dysplasia if it is unable to receive a rating of Fair, Good, or Excellent as determined by radiographic screening of Pet between age of 24 and 26 months performed under general anesthesia.
Seller has no liability after age 26 months, as it is understood that a multitude of environmental factors contribute to hip dysplasia and joint problems, including nutrition, obesity, or injury. Pet is guaranteed to the extent of hereditary conditions only. Should Owner claim that Seller Guarantee has failed to be satisfied, Owner shall demonstrate to Seller’s sole satisfaction that Owner’s Responsibilities (see below) have been met together with documentation of conditions of Seller’s Guarantee (above). Upon acceptance of Owner’s claim, Seller will select remedy, either refund of 50 percent of total amount paid by Owner to Seller or placing Owner next in line for a replacement pet from a subsequent breeding.
Seller does not guarantee:1. Pet’s size, color, temperament, or the ability to reproduce.2. Pet to be free of ear mites, worms, or bacterial infections.3. Pet to be clear of PRA, EIC, CNM, or any other “genetic” or “congenital” defects, or other health concerns, except which Seller expressly guarantees herein. Owner’s Responsibilities:1. Owner agrees to maintain Pet’s physical and mental health in good condition.2. Owner agrees to cover any and all costs and expenses incurred after Pet leaves Seller’s care, including but not limited to regular wellness checks, yearly exams, or any other veterinarian expenses, such as associated with diagnosis, treatment, or management of any medical condition, including possible life-altering genetic defects.3. Owner agrees to provide a suitable area for Pet, together with adequate food, water, shelter, and to be housed securely.4. Owner agrees that if at any time Owner decides to relinquish ownership of Pet for any reason, other than at such time as euthanasia is medically justified, Seller must be notified and given right of first refusal.5. Owner agrees to cover all transportation costs of Pet. Seller does not assume any responsibility for the shipping costs if Pet is required to be shipped back to Seller.6. Seller is not responsible for any costs or expenses incurred by Pet or Owner. Owner agrees to defend, indemnify, and hold Seller harmless from and against any and all claims or damages arising from or in any way related to any action or inaction of Pet or Owner.
